These Terms of Service ("Terms") govern your access to and use of SmartRestro, operated by SmartRestro ("Company", "we", "us"). By creating an account or using any part of the service, you agree to be bound by these Terms.
If you are using SmartRestro on behalf of a business, you represent that you have authority to bind that business to these Terms.
Plain English: By signing up, you agree to these rules. Read them — they're written to be fair and clear, not to trap you.
SmartRestro provides a cloud-based restaurant management platform including (but not limited to): online ordering system, POS, menu management, delivery rider tracking, analytics, financial reporting, and custom domain support.
We reserve the right to modify, suspend, or add features at any time. We will notify users of significant changes. We are not obligated to continue offering any specific feature indefinitely, though we will provide reasonable notice before removing features that existing users depend on.
You must provide accurate, current information when creating an account. You are responsible for maintaining the security of your account credentials. Do not share your password.
Each subscription covers one restaurant entity. Multi-branch management is available under a single account. You may not use a single account to operate services for multiple independent restaurant businesses.
You are responsible for all activity under your account. Notify us immediately at support@smartrestro.pro if you suspect unauthorized access. We are not liable for losses from unauthorized account use due to your failure to protect credentials.
You agree not to use SmartRestro to:
Violation of acceptable use may result in immediate account suspension without refund.
SmartRestro operates on a monthly subscription model. Payment is due at the start of each billing cycle. Failure to pay within 7 days of the due date may result in service suspension.
New accounts receive a 14-day free trial with full access. No credit card is required for the trial. After the trial, you must subscribe to continue using the service.
We do not offer refunds for partial months. If you cancel mid-cycle, your account remains active until the end of the paid period. Refunds may be considered on a case-by-case basis for exceptional circumstances — contact us.
We will provide at least 30 days notice before increasing subscription prices. Existing subscribers will have the option to cancel before the new pricing takes effect.
SmartRestro charges zero commission on orders. All revenue from your restaurant's orders goes directly to you. Our only charge is the flat monthly subscription fee.
You retain full ownership of your content — menu items, images, customer data, order history, financial records, and all other data you input into SmartRestro.
You grant SmartRestro a limited license to store, process, and display your content solely for the purpose of providing the service to you. We do not use your restaurant's business data for any other purpose.
You are responsible for the accuracy and legality of your content. Do not upload content that infringes on third-party rights or violates applicable laws.
The SmartRestro platform, including its code, design, features, and branding, is owned by SmartRestro and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the SmartRestro platform.
The SmartRestro name, logo, and "Smart Restro" brand are trademarks of SmartRestro. You may not use them without written permission, except to refer to the service in a factually accurate way.
You may connect your own domain to SmartRestro. You are responsible for owning and maintaining the domain registration. SmartRestro is not responsible for domain expiration, DNS configuration errors made by you, or third-party domain registrar issues.
If your account is suspended or terminated, your custom domain will stop resolving to SmartRestro services. Ensure your DNS is updated promptly to avoid disruption to your customers.
We target 99% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. We are not liable for losses caused by service downtime, outages, or technical failures beyond our reasonable control.
SmartRestro is provided "as is." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
In no event shall SmartRestro be liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, or loss of data — arising from your use of the service.
Our total liability to you for any claim shall not exceed the amount you paid to SmartRestro in the 3 months preceding the claim.
You may cancel your account at any time from your dashboard or by contacting us. Cancellation takes effect at the end of the current billing period.
We may suspend or terminate accounts for violations of these Terms, non-payment, or any activity that threatens the platform or other users. We will provide notice where possible, except in cases of serious violations requiring immediate action.
After account termination, your data is retained for 90 days before permanent deletion. You may export your data during this period. After 90 days, all data is permanently and irreversibly deleted.
These Terms are governed by the laws of the Islamic Republic of Pakistan. Any disputes shall be resolved in the courts of Peshawar, Khyber Pakhtunkhwa, Pakistan, unless applicable local consumer protection laws in your jurisdiction require otherwise.
For users in the European Union, mandatory consumer protection laws of your country of residence apply where they provide greater protection than these Terms.
We may update these Terms periodically. We will notify you by email and in-app notification at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance of the updated Terms.
If you do not agree to updated Terms, you may cancel your account before they take effect.
